Welcome to CatchUpBuddei! These Terms & Conditions ("Terms") govern your access to and use of the CatchUpBuddei digital name card platform, website, public landing pages, and associated NFC hardware (collectively, the "Service"). By activating your NFC hardware, creating a profile, or accessing our Service, you agree to be bound by these Terms.
1. Account Activation & Eligibility
• Google SSO: To activate and manage your CatchUpBuddei profile, you must authenticate using a valid Google account. You agree to provide accurate, current, and complete profile information.

• Age Requirement: The Service is intended for individuals who are at least 18 years of age. If you are under 18, you represent that you have obtained express parental or legal guardian consent to use the Service.
2. Use of Service & Content Guidelines
• Public Landing Page & Visibility: You acknowledge and agree that information you enter into your profile (including full name, phone number, bio, avatar, and social links) will be publicly accessible to anyone who taps your NFC hardware or visits your unique profile URL.

• User Content License: You retain ownership of all photos, logos, and text uploaded to your profile. However, by uploading content, you grant CatchUpBuddei a non-exclusive, worldwide, royalty-free, sublicensable license to host, display, reproduce, and distribute that content solely for the purpose of operating and displaying your public profile.

• Prohibited Content & Misrepresentation: You agree not to upload, post, or link to content that is unlawful, defamatory, obscene, fraudulent, or infringing on third-party intellectual property. You shall not impersonate any person or entity or misrepresent your professional credentials. All content must strictly comply with Malaysian laws, including the Communications and Multimedia Act 1998 (CMA).

• Anti-Scraping & Data Protection: The Service is intended solely for personal and professional contact exchange. You are strictly prohibited from using automated scripts, bots, spiders, or web crawlers to harvest, scrape, or bulk-collect contact information or personal data from CatchUpBuddei public profiles.
3. NFC Hardware, Compatibility & Modifications
• Hardware Care & Warranty: CatchUpBuddei provides the digital cloud platform linked to your physical NFC hardware. We are not liable for physical degradation, hardware loss, water damage, or physical misuse after delivery.

• Device & OS Compatibility: While we format vCards (.vcf) and web redirects for maximum cross-platform compatibility, CatchUpBuddei does not guarantee 100% device parsing or automatic contact saving across all third-party smartphones due to varying OS restrictions, hardware differences, or disabled NFC settings.

• Hardware Modification & Rewriting: Altering, re-encoding, or overwriting the default URL payload stored on the physical NFC chip using third-party tools voids hardware support. CatchUpBuddei is not liable for device malfunctions resulting from third-party chip re-programming.
4. Intellectual Property & Brand Integrity
• Platform Ownership: The "CatchUpBuddei" name, logos, system software, user interfaces, and platform architecture are the exclusive intellectual property of CatchUpBuddei.

• Viral Branding: The "Powered by CatchUpBuddei" (or similar) attribution link featured on public landing pages is an integral part of the Service tier. You agree not to intentionally block, alter, remove, or obscure this attribution.
5. Limitation of Liability
To the maximum extent permitted under applicable Malaysian law, CatchUpBuddei, its operators, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages resulting from:
  1. Your use of, or inability to use, the Service or physical NFC hardware.
  2. Any unauthorized access, alteration, or distribution of your public landing page by third parties.
  3. Profile downtime, data loss, or technical interruptions.
6. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute or claim arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Malaysia.
